Terms & Conditions

Mara Spirit Safaris – Terms & Conditions

Thank you for choosing Mara Spirit Safaris. These Terms & Conditions apply to all safari, tour, transfer, accommodation and travel services booked through Mara Spirit Safaris. By confirming a booking and making payment, you acknowledge that you have read, understood and accepted these terms.

1. Booking Confirmation

A safari booking is considered confirmed once Mara Spirit Safaris has received the required deposit or full payment and issued a booking confirmation.

All bookings are subject to availability of accommodation, safari vehicles, activities and other services included in the itinerary.

2. Deposits and Payments

The deposit required to confirm your safari will be stated in your quotation or invoice. The remaining balance must be paid by the due date indicated on your invoice.

Bookings made close to the safari departure date may require full payment at the time of confirmation.

Failure to make payment by the agreed deadline may result in cancellation of the booking or release of accommodation and other reserved services.

3. Prices

Safari prices are based on the itinerary, travel dates, number of travellers, accommodation, transport, park and conservation fees, activities and other services specified in your quotation.

Unless otherwise stated, services or activities not specifically listed as included in the quotation are not included in the safari price.

Before confirmation, prices may change due to changes in accommodation rates, park or conservation fees, government taxes, fuel costs, exchange rates or other supplier charges.

4. Cancellations by the Client

All cancellations must be communicated to Mara Spirit Safaris in writing.

Cancellation charges will depend on the date of cancellation and the conditions imposed by hotels, camps, airlines, park authorities and other suppliers involved in the booking.

Some payments, including certain accommodation deposits, park and conservation fees, permits, domestic flights, activities and other third-party services, may be non-refundable once booked.

Where a refund is applicable, any non-refundable supplier charges, transaction costs or other applicable charges will be deducted before the balance is refunded.

5. Changes Requested by the Client

We understand that travel plans may change. Mara Spirit Safaris will make reasonable efforts to accommodate requested changes, subject to availability.

Changes to travel dates, accommodation, destinations, activities, number of travellers or other confirmed arrangements may result in additional charges.

6. Changes or Cancellations by Mara Spirit Safaris

Mara Spirit Safaris reserves the right to make reasonable changes to an itinerary where necessary due to weather conditions, road conditions, accommodation availability, park regulations, safety concerns or circumstances beyond our reasonable control.

Where possible, we will provide a suitable alternative of a similar standard and communicate significant changes to the client.

7. Accommodation

Accommodation is booked according to the confirmed itinerary and is subject to availability at the time of booking.

If a confirmed property becomes unavailable for reasons outside our reasonable control, we will make reasonable efforts to arrange suitable alternative accommodation of a comparable standard.

8. Safari Vehicles and Transport

Safari vehicles are arranged according to the itinerary and type of safari booked. Vehicle changes may occasionally be necessary due to mechanical issues, operational requirements or other circumstances.

Where such a change is necessary, Mara Spirit Safaris will make reasonable efforts to provide a suitable replacement vehicle.

9. Wildlife Sightings

Kenya’s wildlife lives freely in natural environments. While our guides make every reasonable effort to provide excellent wildlife-viewing opportunities, sightings of particular animals, including the Big Five, predators or Great Migration river crossings, cannot be guaranteed.

Wildlife movements are influenced by natural factors including weather, rainfall, food availability and animal behaviour.

10. Travel Documents and Entry Requirements

Each traveller is responsible for ensuring that they hold a valid passport, visa or Electronic Travel Authorisation (eTA), vaccination certificates and any other documents required for travel to Kenya or any other destination included in their journey.

Clients should verify current entry and health requirements with the appropriate official authorities before travelling.

11. Travel Insurance

Mara Spirit Safaris strongly recommends that all travellers obtain comprehensive travel insurance before beginning their journey.

Insurance should, where appropriate, provide cover for medical emergencies, evacuation, trip cancellation or interruption, lost or delayed baggage and other unexpected travel-related circumstances.

12. Health and Medical Requirements

Travellers are responsible for obtaining appropriate medical advice regarding vaccinations, medication and other health precautions before travelling.

Clients should inform us before travel of any mobility requirements, allergies, dietary requirements or other circumstances that may affect the arrangements required for their safari.

13. Flights and Delays

Mara Spirit Safaris is not responsible for airline schedule changes, flight cancellations, missed connections or delays outside our reasonable control.

If such changes affect your safari, we will make reasonable efforts to assist with adjusting your arrangements. Additional costs resulting from flight disruptions may be payable by the traveller or claimed through the traveller’s insurance where applicable.

14. Force Majeure

Mara Spirit Safaris cannot be held responsible for failure or delay in providing services caused by circumstances beyond our reasonable control.

These may include severe weather, natural disasters, epidemics or pandemics, government restrictions, civil disturbances, strikes, road closures, park closures or other extraordinary events.

15. Responsibility and Liability

Mara Spirit Safaris takes reasonable care when arranging safari and travel services. Some services, including accommodation, flights and certain activities, may be provided by independent third-party suppliers.

To the extent permitted by applicable law, Mara Spirit Safaris will not be responsible for loss, damage, delay, injury or additional expenses resulting from circumstances outside our reasonable control or the independent actions of third-party service providers.

Nothing in these Terms & Conditions is intended to exclude or limit any liability that cannot legally be excluded under applicable law.

16. Guest Conduct and Safety

Guests are required to follow reasonable safety instructions provided by safari guides, park authorities, accommodation staff and other authorised personnel.

Guests must respect wildlife, local communities, conservation areas and applicable park rules throughout their safari.

17. Optional Activities

Optional activities such as hot-air balloon safaris, cultural visits, boat rides and other excursions are only included when specifically stated in the confirmed itinerary.

Optional activities may be operated by independent providers and may be subject to their own terms, availability and cancellation policies.

18. Complaints

If you experience a problem during your safari, please notify your guide or Mara Spirit Safaris as soon as possible so that we have an opportunity to assist and resolve the matter during your trip.

Any unresolved complaint should be submitted to us in writing together with your booking details and relevant information.

19. Governing Law

These Terms & Conditions are governed by the laws of Kenya. Any dispute relating to a booking with Mara Spirit Safaris will be handled in accordance with applicable Kenyan law.
